Creative Commons di Indonesia

Creative Commons adalah sekumpulan lisensi bebas yang dapat digunakan sebagai aturan ketika kita mendistribusikan sebuah karya. Creative Commons sangat populer di kalangan blog, termasuk blog saya ini yang menggunakan lisensi Creative Commons Attribution Share Alike License. Artinya, saya memperbolehkan siapapun menggunakan tulisan di blog ini selama yang bersangkutan menyatakan bahwa saya yang membuat tulisan tersebut dan mendistribusikan tulisan saya atau modifikasinya dengan lisensi yang sama.

Lisensi-lisensi Creative Commons sudah diterjemahkan ke dalam berbagai bahasa, tetapi sayangnya belum ke dalam Bahasa Indonesia.

Untuk menerjemahkan lisensi-lisensi Creative Commons ke dalam Bahasa Indonesia, dibutuhkan seorang pemimpin proyek. Kriteria pemimpin proyek ini seperti yang disebut dalam Creative Commons Worldwide adalah sebagai berikut:

The Project Lead is the central figure for the porting of the licenses into national law. He/she would be an expert in copyright law, more often than not a lawyer, and more often than not associated with the Institution or Law Firm. In some jurisdictions Creative Commons International will identify the Project Lead first and ask him/her for help in finding a renowned copyright Institution or renowned Law Firm. In other jurisdictions, we will be in contact with the Institution/Firm first and will try to find a Project Lead from within.

Dalam dokumen License Process, disebutkan pula bahwa pemimpin proyek harus memiliki kriteria sebagai berikut:

  • Professional legal credentials and reputation, generally
  • Reputation among copyright and intellectual property experts
  • Enthusiasm for the project
  • Willingness to work within the framework described in these Guidelines
  • Ability to communicate in English
  • Willingness to establish contacts and to collaborate with experts in the technology field

Setelah itu, dibutuhkan pula kerjasama dengan sebuah firma hukum atau institusi hak cipta. Kriterianya adalah sebagai berikut:

  • Locally run, owned, managed. Buy-in from local organisations may be more successful if the host organisation has a strong local network and is based within the country in concern. It is also useful for the host institution to have some international links so that the project is set within both a local and global context of ideas.
  • Mandate of host institution and potential for independence of CC project. It is important that the cc national project is not hindered by institutional policies that may conflict with CC goals. This may be related to the advocacy role of the institution in relation to cc’s present and future activities.
  • Copyright/Internet law expertise. The institution should have a good track record or at least knowledge and interest in the national and international Internet law and policy sector.
  • Professional network. The institution should be well placed within a local, regional and global network of professionals who will implement CC ideas after the licenses have been for mulated.
  • Prestige. Institutional prestige within the field of Internet law, copyright and progressive ICT policies is a plus because it allows the subject of CC licenses to be discussed within a legitimate organisation.
  • Willingness to collaborate. The institution should have, in informal discussions, expressed support for the project and willingness to donate resour ces (of time and/or funds) to support CC.
  • Capacity. The institution should have the human capacity to initiate discussions and at least do some work on licenses before/if funding is sought for additional activities.
